Adaptive mutation is defined as a process that, during nonlethal selections, produces mutations that relieve the selective pressure whether or not other, nonselected mutations are also produced. Examples of adaptive mutation or related phenomena have been reported in bacteria and yeast but not yet outside of microorganisms. A decade of research on adaptive mutation has revealed mechanisms that may increase mutation rates under adverse conditions. This article focuses on mechanisms that produce adaptive mutations in one strain of Escherichia coli, FC40. (...) This article examines the notorious mid-nineteenth-century American trial of Amelia Norman, who was acquitted - very much against the weight of the evidence - of attempting to kill the man who seduced her. In particular, we explore the role in the trial and its aftermath of the affective energies and cultural expectations set in motion by best-selling American sentimental novels like Hannah Foster's "The Coquette" and Susanna Rowson's "Charlotte Temple." In Norman's case, once newspapers, defense lawyers, and reformers such (...) as Lydia Maria Child recast the defendant as a sentimental heroine, the trial became about seduction, not attempted murder. The sentimental emplotment of Norman's life marshaled a powerful set of emotional responses and moral judgments on her behalf. For example, Norman claimed insanity. And since sentimental heroines are supposed to go mad when they are seduced and abandoned, the jury was prepared to interpret her symptoms according to her lawyers' very strategy for establishing her innocence. Ultimately, however, Norman embodied the plight of the sentimental heroine at the same time that she contested her fictional counterpart's fate. In this way, her trial spectacularized the disparity which the sentimental novel conjures up and displaces but never resolves. Going further, the common law theory of coverture, which severely limited the legal personhood of married women, has received a great deal of scholarly attention. Cases like Norman's remind us that unmarried women were also subject to draconian constraints on their legal personhood. The tort of seduction is a key example. Legal historians trace the development of the seduction tort from its common-law origins, when men's property interest in women's bodies formed the basis of the cause of action, to 1851, when Field Code authors (including Norman's lawyer, David Graham) persuaded several states to grant seduced women standing to bring their own cause of action. Consequently, courts were forced to reckon with the seduced woman as a moral agent capable of consenting to sex. As trials like Norman's demonstrate, sentimental novels helped lay the groundwork for this shift in the law by elucidating a subjectivity for the seduced woman. Yet the doctrinal implications of Norman's precedent-setting trial had a second, more ambiguous strain. Other women facing similar charges used the same legal strategy to gain acquittals in a substantial number of cases. Indeed, Norman's sentimental strategy proved so powerful that men on trial for killing their wives' seducers appropriated it to bring their own stories before juries and to reinforce male sexual norms through the so-called honor defense. In the end, then, Norman's trial fostered legal reform, but it also suggested - as Lydia Maria Child's fictionalization of the case in "Rosenglory" recognized - that only sustained and multifaceted efforts to change cultural as well as legal norms could improve the sexual status of women. In addition to its legal, literary, and historical insights that it provides, we also intend this article to contribute to debates on the nature of scholarship in law and literature. Scholars such as Wai Chee Dimock have argued for a focus on the historical and historically shifting relations between law and literature - a view we endorse. Where we differ from Dimock is in our diversion of attention away from abstract ideas of law laid out by treatise writers and philosophers in favor of law experienced and manipulated by individuals. So, too, we are interested less in representations of concepts such as justice in legal and literary texts than we are in the ways in which literature (broadly conceived) can create provisional and fragile opportunities for concrete instantiations of justice and even generate legal change (for good or ill). We would argue that to the extent legal change motivates rather than simply mirrors cultural change, it needs literature to be effective. This project, then, responds to Gregg Crane's call for attention to the complex and slippery historical interactions of law and literature that shape and are shaped by an ever changing cultural idiom of justice. The extended story of Amelia Norman, in short, not only constitutes a case study in the inescapable interaction between the overlapping and interdependent discourses of law and literature, but also reveals the literary and legal consequences of that interaction. This article examines how ‘trauma’ has been conceptualised in the unresolved state of mind classification in the Adult Attachment Interview, introduced by Main and Hesse in 1990. The unresolved state of mind construct has been influential for three decades of research in developmental psychology. However, not much is known about how this measure of unresolved trauma was developed, and how it relates to other conceptualisations of trauma. We draw on previously unavailable manuscripts from Main and Hesse's personal archive, including various (...) editions of unpublished coding manuals, and on Main–Bowlby correspondence from the John Bowlby Archive at the Wellcome Trust in London. This article traces the emergence of the unresolved state of mind classification, and examines the assumptions about trauma embedded in the construct. These assumptions are situated both in the immediate context of the work of Main and Hesse and in terms of wider discourses about trauma in the period. Our analysis considers how a particular form of trauma discourse entered into attachment research, and in doing so partly lost contact with wider disciplinary study of trauma. (shrink)

The process of engaging in historical empathy holds the potential for significant curricular and dispositional benefits for students in history classrooms. In order to realize these benefits, classroom teachers must be able to integrate historical empathy into their existing planning and teaching; a process that would benefit from empirical examination. This single subject case study examined the pedagogical reasoning process of an experienced classroom teacher who integrated historical empathy into an existing instructional unit designed to foster student knowledge of (...) social control as an enduring historical understanding. The findings of this study suggest that experienced teachers may only be able to partially anticipate the unique pedagogical needs integrating historical empathy requires, and that a holistic examination of pedagogical reasoning during all phases of planning and teaching may be most suitable for the task. Our paper explores how the affective energies and cultural expectations set in motion by best-selling American sentimental novels like Hannah Foster's The Coquette and Susanna Rowson's Charlotte Temple informed the notorious mid-nineteenth-century American trial of Amelia Norman, who attempted to kill the man who seduced her. Once newspapers, defense lawyers, and reformers such as Lydia Maria Child recast the defendant as a sentimental heroine, the trial became about seduction, and Norman was acquitted against the weight of the evidence. This new edition of the classic Contemporary Theories of Knowledge has been significantly updated to include analyses of the recent literature in epistemology.

The objective of this book is to produce a theory of rational decision making for realistically resource-bounded agents. My interest is not in “What should I do if I were an ideal agent?”, but rather, “What should I do given that I am who I am, with all my actual cognitive limitations?” The book has three parts. Part One addresses the question of where the values come from that agents use in rational decision making. The most comon view among philosophers (...) is that they are based on preferences, but I argue that this is computationally impossible. I propose an alternative theory somewhat reminiscent of Bentham, and explore how human beings actually arrive at values and how they use them in decision making. Part Two investigates the knowledge of probability that is required for decision-theoretic reasoning. I argue that subjective probability makes no sense as applied to realistic agents. I sketch a theory of objective probability to put in its place. Then I use that to define a variety of causal probability and argue that this is the kind of probability presupposed by rational decision making. So what is to be defended is a variety of causal decision theory. Part Three explores how these values and probabilities are to be used in decision making. In chapter eight, it is argued first that actions cannot be evaluated in terms of their expected values as ordinarily defined, because that does not take account of the fact that a cognizer may be unable to perform an action, and may even be unable to try to perform it. An alternative notion of “expected utility” is defined to be used in place of expected values. In chapter nine it is argued that individual actions cannot be the proper objects of decision-theoretic evaluation. We must instead choose plans, and select actions indirectly on the grounds that they are prescribed by the plans we adopt. However, our objective cannot be to find plans with maximal expected utilities. Plans cannot be meaningfully compared in that way. (shrink)

There was a long tradition in philosophy according to which good reasoning had to be deductively valid. However, that tradition began to be questioned in the 1960’s, and is now thoroughly discredited. What caused its downfall was the recognition that many familiar kinds of reasoning are not deductively valid, but clearly confer justification on their conclusions. Here are some simple examples.

When your word processor or email program is running on your computer, this creates a “virtual machine” that manipulates windows, files, text, etc. What is this virtual machine, and what are the virtual objects it manipulates? Many standard arguments in the philosophy of mind have exact analogues for virtual machines and virtual objects, but we do not want to draw the wild metaphysical conclusions that have sometimes tempted philosophers in the philosophy of mind. A computer file is not made of (...) epiphenomenal ectoplasm. I argue instead that virtual objects are “supervenient objects.” The stereotypical example of supervenient objects is the statue and the lump of clay. To this end I propose a theory of supervenient objects. Then I turn to persons and mental states. I argue that my mental states are virtual states of a cognitive virtual machine implemented on my body, and a person is a supervenient object supervening on this cognitive virtual machine. (shrink)

The usual meaning of the word continuous is “unbroken” or “uninterrupted”: thus a continuous entity —a continuum—has no “gaps.” We commonly suppose that space and time are continuous, and certain philosophers have maintained that all natural processes occur continuously: witness, for example, Leibniz's famous apothegm natura non facit saltus—“nature makes no jump.” In mathematics the word is used in the same general sense, but has had to be furnished with increasingly precise definitions. So, for instance, in the later 18th century (...) continuity of a function was taken to mean that infinitesimal changes in the value of the argument induced infinitesimal changes in the value of the function. With the abandonment of infinitesimals in the 19th century this definition came to be replaced by one employing the more precise concept of limit. (shrink)

It has long been claimed that Homo sapiens is the only species that has language, but only recently has it been recognized that humans also have an unusual pattern of growth and development. Social mammals have two stages of pre-adult development: infancy and juvenility. Humans have two additional prolonged and pronounced life history stages: childhood, an interval of four years extending between infancy and the juvenile period that follows, and adolescence, a stage of about eight years that stretches from juvenility (...) to adulthood. We begin by reviewing the primary biological and linguistic changes occurring in each of the four pre-adult ontogenetic stages in human life history. Then we attempt to trace the evolution of childhood and juvenility in our hominin ancestors. We propose that several different forms of selection applied in infancy and childhood; and that, in adolescence, elaborated vocal behaviors played a role in courtship and intrasexual competition, enhancing fitness and ultimately integrating performative and pragmatic skills with linguistic knowledge in a broad faculty of language. A theoretical consequence of our proposal is that fossil evidence of the uniquely human stages may be used, with other findings, to date the emergence of language. If important aspects of language cannot appear until sexual maturity, as we propose, then a second consequence is that the development of language requires the whole of modern human ontogeny. Our life history model thus offers new ways of investigating, and thinking about, the evolution, development, and ultimately the nature of human language. (shrink)

This special issue presents developments in research on the cognitive mechanisms and consequences of surprise. Amidst much progress, surprise research has often been siloed, so, as editors, we have sought to juxtapose insights, theories, and findings, to support cross‐fertilization in future research. The present paper sets the stage by presenting a historical summary, highlighting contrasts in definitions, and tracing major threads running through this issue and the larger surprise literature.

Probability is sometimes regarded as a universal panacea for epistemology. It has been supposed that the rationality of belief is almost entirely a matter of probabilities. Unfortunately, those philosophers who have thought about this most extensively have tended to be probability theorists first, and epistemologists only secondarily. In my estimation, this has tended to make them insensitive to the complexities exhibited by epistemic justification. In this paper I propose to turn the tables. I begin by laying out some rather simple (...) and uncontroversial features of the structure of epistemic justification, and then go on to ask what we can conclude about the connection between epistemology and probability in the light of those features. My conclusion is that probability plays no central role in epistemology. This is not to say that probability plays no role at all. In the course of the investigation, I defend a pair of probabilistic acceptance rules which enable us, under some circumstances, to arrive at justified belief on the basis of high probability. But these rules are of quite limited scope. The effect of there being such rules is merely that probability provides one source for justified belief, on a par with perception, memory, etc. There is no way probability can provide a universal cure for all our epistemological ills. A theory of rational choice is a theory of how an agent should, rationally, go about deciding what actions to perform at any given time. For example, I may want to decide whether to go to a movie this evening or stay home and read a book. The actions between which we want to choose are perfectly ordinary actions, and the presumption is that to make such a decision we should attend to the likely consequences of our decision.
